The products made available on this site are for strictly personal use. In case of order of products for resale,
S'SENSE VEGETAL reserves the right to refuse the order.
The orders are prepared by us in Sainte-Florine. We reserve the right to offer you S'SENSE VEGETAL goodies.
1. Purpose of the General Terms and Conditions of Sale
1.1. To what do these terms and conditions apply?
The present conditions of sale apply, without restriction or reserve, to all sales concluded between, on the one hand, the company S'SENSE VEGETAL, a simplified joint stock company, registered in the register of commerce and companies of Puy en Velay under the number 882 337 629, whose head office is : 28 T rue Ambroise Thomas 43250 Sainte-florine, whose intra-community VAT number is FR75882337629, whose trade name is S'SENSE VEGETAL (hereinafter referred to as " S'SENSE VEGETAL"), and on the other hand, any non-professional purchaser (hereinafter referred to as the "customer" or "customers") wishing to acquire the products offered for sale by S'SENSE VEGETAL (hereinafter referred to as the "products") via the website (hereinafter referred to as the "Website"). They specify in particular the conditions of order, payment, delivery and management of possible returns of the Products ordered by the customers.
1.2 What products do we offer?
The products offered for sale on the website are food supplements, plant extracts, cosmetics and care products. The main characteristics of the products and in particular the specifications, illustrations and indications of dimensions or capacity of the products, are presented on the website. The customer is obliged to take note of these before placing an order. The choice and purchase of a product is the sole responsibility of the customer. The customer takes note that the S'SENSE VEGETAL products meet the French standards and requirements. If the customer is located abroad, he/she takes the responsibility in full knowledge of the facts for the importation on his/her territory.
The colour and the graphic elements of the packaging can be modified. These modifications do not in any case lead to a modification of the formulation of our products, but may occur for reasons of brand image or stock.
The customer must refer to the description of each product in order to know its properties and essential characteristics.

1.4. What will happen if you accept these terms and conditions?
The validation of the order by the customer implies acceptance without restriction or reservation by the customer of these conditions of sale. The customer acknowledges having the required capacity to contract and acquire the products offered on the website. These conditions of sale will prevail over any other general or particular conditions not expressly approved by S'SENSE VEGETAL. These general conditions of sale are accessible at any time on the website. The customer declares to have read the present general sales conditions and to have accepted them by ticking the box provided for this purpose before the implementation of the online ordering procedure as well as the general conditions of use of the website.
1.5. Can these terms and conditions be modified and if so, under what conditions?
S'sense Vegetal reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of placing the order by the customer. Unless proven otherwise, the data recorded in the computer system of S'sense Vegetal constitute proof of all transactions concluded with the customer. The general conditions of sale are concluded for the duration necessary for the supply of products. In accordance with the Data-processing law and Freedoms of January 6, 1978 as well as the Regulation RGPD, the customer has at any time, a right of access, of correction and opposition to the whole of his personal data by writing, by mail and by justifying his identity, with the address mentioned above.
2.1. How do I place an order with S'sense Vegetal?
The customer can place an order via the Internet on the Website. The Customer who wishes to place an order on the Website must order according to the following procedures:
- create a "customer account" in which he/she will indicate all the requested details.
- create an online basket by selecting all the Products chosen.
- accept these general terms and conditions of sale, validate his/her order after having checked it.
- make the payment under the conditions provided.
Any order implies acceptance without restriction or reservation of these general conditions of sale. Any order implies acceptance of the prices and description of the products available for sale.
The contractual information is presented in French and is subject to confirmation at the latest at the time of validation of the order by the Customer.
From the moment the Customer has validated his order, he is deemed to have accepted with full knowledge of the facts and without reservation the present general conditions of sale, the prices, volumes and quantities of products offered for sale and ordered.
The customer can also place an order via our customer relations department on 0809 542 400 in order to be accompanied in the choice of his cures. The customer will make his choice with full knowledge of the facts and will not be able to sue S'SENSE VEGETAL if medical contraindications are established after taking the food supplement. S'SENSE VEGETAL is not a medical service and does not sell drugs or medical prescriptions. S'SENSE VEGETAL commits itself here to direct the customers to a health professional as soon as necessary. S'sense Vegetal is not a substitute for medicine and cannot be considered as a health professional.
2.2. When will the customer's order be considered final?
The sale will only be considered final after S'SENSE VEGETAL has sent the customer confirmation of the acceptance of the order (with a summary) by e-mail and after S'SENSE VEGETAL has received the full payment. It is up to the customer to check the accuracy of the order and to immediately report any error. Any order placed on the website constitutes the formation of a contract concluded at a distance between the customer and S'SENSE VEGETAL.
2.3 What happens if you order a product that is out of stock?
N.B. Normally, if a product is unavailable or out of stock, the website will not allow customers to place an order.
S'SENSE VEGETAL 's product offers are valid within the limits of available stocks. When an ordered Product is unavailable and/or out of stock, the Customer is informed and is also informed of the availability period of the out-of-stock Product by e-mail or, in the case of an order of several Products, on the invoice of the shipped Products. S'SENSE VEGETAL cannot be held responsible for the unavailability of a Product. In the event of unavailability and/or shortage of stock of one (or more) Product(s), the Customer may request, at his choice:
- A full refund of the unavailable or out-of-stock Product,
- Receive a credit note for the amount of the price of the unavailable or out-of-stock Product to be used for a subsequent order.
Only the definitive rupture of a Product at S'SENSE VEGETAL 's suppliers will lead to the suppression of this one from our sale offer. S'SENSE VEGETAL will then remove this Product from the Website as soon as possible.
Unless proven otherwise, the data recorded by S'SENSE VEGETAL constitute the proof of all the transactions made by S'SENSE VEGETAL and its customers.
3. Offers and prices
3.1 How are changes to our prices handled?
S'SENSE VEGETAL reserves the right to modify its prices at any time but undertakes to apply the prices in force at the time of the order, subject to availability on that date. The Offers and Products are provided at the rates in force on the Website, when the order is placed.
3.2 How are the prices of our products indicated? What about shipping costs and promotional offers?
The prices of the products are indicated in euros, all taxes included, and do not take into account the expenses of delivery, invoiced in supplement, and indicated before the validation of the order, of packing and treatment of the order.
Promotional offers are valid during the period of validity they mention and as long as they are displayed on the Website, as well as within the limits of available stocks. Orders can only be accepted if the prices mentioned are in line with those of the current offer.
The price is payable in cash, in full and in a single payment on the day the order is placed by the Customer, by secure payment. At no time, the sums paid may be considered as deposits or down payments. No cash on delivery will be accepted, for any reason whatsoever. If one or more taxes or contributions, in particular environmental, were to be created or modified, in rise or fall, this change could be reflected in the selling price of the products.
All orders are invoiced in Euros and payable in Euros. For orders delivered abroad, the various taxes applied by the country or region of destination will be charged to the customer receiving the package.
S'SENSE VEGETAL reserves the right, in the event of non-compliance with the terms of payment, to suspend or cancel the delivery of current orders placed by the Customer.
N.B. Delivery is the transfer to the Customer of physical possession or control of the Product.
4.1. How are the delivery costs calculated?
For each order, a fixed contribution to the costs of provision is requested, which includes postage, packaging and processing of the order. The fixed contribution is indexed to the delivery method chosen by the Customer at the time of placing the order. Delivery costs can be free of charge from 45 € for any delivery on the French metropolitan territory.
For other destinations, in particular for foreign countries, a higher participation according to the price of the routing practised by our service provider can be asked.
The contribution to the shipping costs is understood to include VAT.
In order to reduce transport costs, all small or medium-sized Products are sent by the Colissimo Suivi service of La Poste, which undertakes to deliver within forty-eight (72) hours throughout France and offers the Customer the possibility of recovering the ordered products at the post office near the delivery address in the event of absence from the initial place of delivery when the postman arrives. If the Customer is absent on the day of delivery, the postman will leave a notice in his letterbox, which will allow him to collect his parcel at the post office during opening hours, within fifteen days. The Customer is able to follow his order thanks to the Colissimo number which is sent to him by email the day of the expedition of his order.
For reasons of availability, an order can be delivered in several times to the Customer. In this case, the Customer only pays for one delivery.
4.2. What are the delivery times?
S'SENSE VEGETAL undertakes to do its best to deliver the Products ordered by the Customer as soon as possible. For more information, we invite you to read our delivery conditions. However, if the Products ordered have not been delivered within thirty (30) days after the order has been placed, the Customer must inform S'SENSE VE GETAL as soon as possible, by telephone or by email.
For deliveries abroad a reasonably longer period is to be taken into account this one being able to reach 15 days after the notification of sending of the parcel.
S'SENSE VEGETAL will contact the carrier so that the latter can carry out an investigation, which may last up to twenty-one (21) days. If the Products are found, they will be forwarded to the Customer's home. If the Products are not found at the end of the investigation, the Products will be deemed lost and S'SENSE VEGETAL will then be able to send back to the Customer replacement Products, at no extra cost for the Customer. If the ordered Products are no longer available, S'SENSE VEGETAL will refund the amount of the Products deemed lost.
In any case, if the Products were not delivered within ten (10) days after the indicative date of delivery, for any other cause than the force majeure or the fact of the Customer, the sale could be cancelled at the written request of the Customer under the conditions envisaged in the articles L. 216-2 to L. 216-4 of the Code of the consumption. The sums paid by the Customer will then be restored to him at the latest in the fourteen days which follow the date of denunciation of the contract, with the exclusion of any compensation or retention.
4.3. What happens if you enter the wrong delivery address?
The Products are delivered to the address indicated by the Customer when placing the order. The Customer will have to ensure its accuracy. Any parcel returned to S'SENSE VEGETAL because of an erroneous or incomplete delivery address will be reshipped at the Customer's expense and S'SENSE VEGETAL cannot be held responsible for the impossibility in which it could be to deliver the order. If the Customer wishes to be delivered to two distinct delivery addresses, he must place two distinct orders, with the related delivery charges.
4.4. What should you do when you receive the order?
Upon receipt of the order, the Customer is required to check the condition of the Products delivered. In the event of apparent defects, the Customer has the right to return the Products in accordance with the conditions set out in these general conditions. Any anomaly concerning the delivery (missing or damaged Products, damaged packages) must imperatively be indicated, in the first place, on the delivery slip and in the form of handwritten reserves accompanied by the customer's signature to the carrier. Secondly, any anomaly must be notified as soon as possible after receipt of the Products to S'SENSE VEGETAL :

S'SENSE VEGETAL will ask the Customer to return the damaged Product(s).
4.5 I received a damaged package. What should Ido?
If the Customer notes at the time of delivery of his package to be handed over against signature that the latter is damaged, he can, at his choice, refuse the package which will then be directly returned to S'SENSE VEGETAL or receive the package while reporting the deterioration of its packaging.
If the Customer notices that the packaging of his parcel to be delivered to the mailbox is damaged, he may, provided that the parcel has not been opened, refuse the parcel by returning it to the post office, at the latest on the working day following its delivery.
4.6. How are NPAI returns managed?
The returns under the reason "NPAI" correspond to the parcels returned by the service provider in charge of the delivery under the mention: "Does not live at the indicated address". After reception and acceptance of the returned parcel by S'SENSE VEGETAL, a credit note for the total amount of the order, postage costs deducted, will be credited to the customer's account within forty-eight (96) hours following the reception of the parcel by S'SENSE VEGETAL. The Customer will then be able to place his order again, by ensuring the accuracy of the delivery address provided.
4.7. How are returns handled under the reason "unclaimed"?
The returns under the reason "unclaimed" correspond to the parcels that have not been claimed by the Customers at the post office or at the shop chosen by the customer when ordering within fifteen (15) days from the notice of passage. After receipt and acceptance of the returned package by S'SENSE VEGETAL, a credit note for the total amount of the order, minus shipping costs, will be credited to the customer's account within forty-eight (72) hours following receipt of the package by S'SENSE VEGETAL. The Customer will then be able to place his order again.
5. Right of withdrawal
5.1. What is the withdrawal period?
In application of the provisions of article L. 221-19 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the order to exercise his right of withdrawal from S'SENSE VEGETAL, without having to justify his reasons or pay a penalty, for reimbursement, provided that the Products are returned in their original packaging, complete and in perfect condition, allowing them to be sold again.
5.2. What do I have to do to exercise my right of withdrawal?
Damaged, already opened, soiled or incomplete products will not be taken back. The Products must be returned within fourteen (14) days following the notification to S'SENSE VEGETAL of the Customer's decision to withdraw. This period starts at the beginning of the first hour of the first day and ends at the end of the last hour of the last day of the period. If this period expires on a Saturday, a Sunday or a holiday or day off, it is extended until the first following working day.

It is advisable to return the package by tracked mail, in the event that it would be lost in the mail, the responsibility of S'SENSE VEGETAL can not be engaged in this regard.
6.1. How and in which cases will you proceed with the reimbursement?
In case of non-receipt of the order within the above-mentioned delivery deadlines, for any other cause than force majeure or the fact of the Customer, the sale could be cancelled at the written request of the Customer, under the conditions envisaged in the articles L. 216-2 of the Code of consumption. The sums paid by the Customer will then be restored to him at the latest in the fourteen (14) days which follow the date of denunciation of the contract by the Customer, with the exclusion of any compensation or retention.
In case of unavailability of the ordered Product, the Customer having opted for the refund will be reimbursed of the sums paid at the latest within fourteen (14) days of their payment.
The Customer will be reimbursed within fourteen (14) days following the reception of the Products by S'SENSE VEGETAL. This reimbursement will be deducted from the shipping costs, even if the order has been exempted from them.
The refund will be made according to the method of payment used by the Customer during his order.
S'SENSE VEGETAL reserves the right to cancel and refund all orders made by a professional.
7. Terms of payment
N.B. This is an order with a payment obligation, which means that the placing of the order implies a payment by the Customer.
7.1. What are the terms of payment?
To pay his order, the Client has the payment method made available by S'SENSE VEGETAL and listed on the Website, namely the MOLLIE service.
The customer guarantees S'SENSE VEGETAL that he/she has the necessary authorizations to use the method of payment chosen by him/her, when validating the order form. S'SENSE VEGETAL reserves the right to suspend any order management and any delivery in case of refusal of authorization of payment by credit card from the officially accredited organizations or in case of non-payment.
S'SENSE VEGETAL does not store any personal or financial information in its database when processing the Customer's payment.
7.2. Payment by credit card
Payment by credit card is made directly online through a secure transaction, with the MOLLIE system. Payment data is exchanged in encrypted mode using the SSL 128-bit protocol (Secure Socket Layer). When the Client orders on the Website, the debit of the bank card is carried out immediately according to the following modalities: the Client indicates in the zone provided, the number of his bank card, without space between the figures, its validity date, as well as the last three figures of the pictogram on the back of the card. The credit card is generally debited when the order is shipped.
The site S'SENSE VEGETAL also allows payment by Paypal and apple pay.
8. Transfer of ownership - Transfer of risk
The transfer of ownership of the Products from S'SENSE VEGETAL, to the Customer, will only take place after full payment of the price by the Customer, whatever the delivery date of the said Products. Whatever the date of the transfer of ownership of the Products, the transfer of the risks of loss and deterioration relating to them will only take place when the Customer takes physical possession of the Products. The Products travel at the risk of S'SENSE VEGETAL.
9.1. What are the applicable legal guarantees?
The Products sold on the Website comply with the regulations in force in France. The Products supplied by S'SENSE VEGETAL benefit by right and without additional payment, independently of the right of withdrawal:
- from the legal guarantee of conformity provided for in articles L. 217-4 and following of the Consumer Code, for the apparently defective, damaged or damaged Products or those that do not correspond to the order,
- from the legal guarantee against hidden defects provided for in articles 1641 and following of the Civil Code, arising from a defect in material, design or manufacture affecting the Products delivered and making them unsuitable for use
9.2 What are the obligations of S'SENSE VEGETAL?
- According to Article L. 217-4 of the Consumer Code, "The seller delivers goods that conform to the contract and is responsible for any defects in conformity that exist at the time of delivery. He is also liable for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility. »
- According to Article L. 217-5 of the Consumer Code, "The goods conform to the contract:
1° If it is fit for the use usually expected of similar goods and, where applicable: if it corresponds to the description given by the seller and has the qualities that the latter has presented to the buyer in the form of a sample or model; if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling;
2° or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter. »
- According to Article L. 217-12 of the Consumer Code "The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods. "
- According to Article 1641 of the Civil Code, "The seller is bound by the warranty for hidden defects in the item sold that make it unsuitable for the use for which it was intended, or that so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if he had known about them. "
- According to Article 1648 of the Civil Code "The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect. »
In order to claim his rights, the Customer must inform S'SENSE VEGETAL, in writing, of the non-conformity of the Products within a maximum delay of two (2) years from the delivery of the Products or the existence of hidden defects within a maximum delay of two (2) years from their discovery.
The Customer may choose between repairing or replacing the good, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code.
Shipping costs will be reimbursed on the basis of the invoiced rate and return costs will be reimbursed on presentation of the receipts.
Refunds for Products judged to be non-conforming or defective will be made as soon as possible and at the latest within thirty (30) days following the observation by S'SENSE VEGETAL of the non-conformity or the hidden defect. The reimbursement will be made by crediting the Customer's bank account or by bank check sent to the Customer.
9.3. In which cases the responsibility of S'SENSE VEGETAL cannot be engaged?
The responsibility of S'SENSE VEGETAL cannot be engaged in the following cases:
- non-compliance with the legislation of the country in which the Products are delivered, which it is up to the Customer to check;
- in case of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer, as well as in case of normal wear and tear of the product, accident or force majeure.
S'SENSE VEGETAL 's guarantee is, in any case, limited to the replacement or reimbursement of products that are not in conformity with the regulations or that are affected by a defect.
10. Intellectual Property
10.1. I like your site. Can I use your photographs, texts, comments or articles?
All trademarks, photographs, texts, comments, illustrations, images, animated or not, video sequences, sounds, as well as all computer applications that could be used on the website and more generally all elements reproduced or used on the website are protected by the laws in force under the intellectual property.
They are the full and entire property of S'SENSE VEGETAL or its partners. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of S'SENSE VEGETAL, is strictly prohibited. The fact that S'SENSE VEGETAL does not initiate proceedings as soon as it becomes aware of these unauthorised uses does not mean that it accepts the said uses and waives any legal proceedings. Any simple link or hypertext link is strictly forbidden without the express written agreement of S'SENSE VEGETAL.

12. Applicable law - Dispute resolution
12.1 How to proceed with any dispute?
In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, S'SENSE VEGETAL adheres to the Service of the Mediator of e-commerce of the FEVAD (Federation of e-commerce and distance selling) whose coordinates are as follows: 60 Rue La Boétie - 75008 Paris - http://www.mediateurfevad.fr.
12.2 When can I contact the mediator for a dispute with S'SENSE VEGETAL?

13. No partial validation
If one or more stipulations of the present general conditions are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their force and their scope.
14. Force majeure
14.1 What are the cases of force majeure and how are they managed?
Any circumstances beyond the control of the parties that prevent the performance of their obligations under normal conditions shall be considered as grounds for exemption from the obligations of the parties and shall result in their suspension.
The party invoking the above circumstances shall immediately notify the other party of their occurrence and of their disappearance.
Will be considered as force majeure all facts or circumstances irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which could not be prevented by the latter, despite all efforts reasonably possible. Expressly, are considered as force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of the courts and French tribunals: the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning, the stoppage of telecommunication networks or difficulties specific to telecommunication networks external to the Customers.
The parties will meet to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued. If the case of force majeure lasts for more than three (3) months, the present general conditions may be terminated by the injured party.
15. Pre-contractual information - Acceptance and rights of the Customer
15.1 What does acceptance of the S'SENSE VEGETAL GTC mean?
The Customer acknowledges having been informed, prior to placing his order, in a legible and comprehensible manner, of the present General Conditions and of all the information and details referred to in Articles L. 111-1 to L. 111-8 of the Consumer Code, and in particular:
- the essential characteristics of the Product, taking into account the communication medium used and the Product concerned;the price of the Product and its ancillary costs;in the absence of immediate execution of the contract, the date or the deadline by which S'SENSE VEGETAL undertakes to deliver the Product;
- information relating to the identity of S'SENSE VEGETAL, its postal, telephone and electronic contact details and its activities, insofar as they are not apparent from the context;
- information relating to the legal guarantees and their implementation modalities;
- the functionalities of the digital content and, if necessary, its interoperability;
- the possibility of resorting to a conventional mediation in case of dispute; information relating to the right of withdrawal.
15.2. Can you assure me that my mobile number will be kept confidential?
Within the order form, we must collect the consumer's mobile phone number in order to contact him/her in case of problems with the processing of his/her order or in case of delivery problems. S'SENSE VEGETAL uses your phone number only in the execution of the contract concluded with the consumer. We remind you that any consumer has the possibility of registering on the list of opposition to the telephone canvassing by the means of this link http://www.bloctel.gouv.fr.
The fact that a natural or legal person places an order on the Website implies full acceptance of these general terms and conditions of sale and the obligation to pay for the Products ordered.
